29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):   a) 767 East 132nd Street, Bronx - NY:  On or about February 22, 2024, an employee was operating a Daewoo powered industrial truck (forklift) to move scrap metal to a dumpster parked on the street without the successful training and evaluation. The employer did not ensure that the operator had successfully completed forklift operator's training.  NOTE: ABATEMENT CERTIFICATION IS REQUIRED FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.1.
