29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE) (a) Hothead Grabba LLC, located at 234 Chestnut Street, Brooklyn, NY 11208 Employees working in the facility performing the processing of raw tobacco leaves were exposed to the hazard of nicotine while using their bare hands to remove the leaves from the stems. Nicotine is absorbed through the skin. The employer failed to assess the workplace to evaluate the hazardous conditions. Condition observed on or about March 4, 2024 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19

Employees are required to wear 3M N95 8210 series particulate respirators by their employer while handling the tobacco leaves. The employer did not provide employees with initial respiratory protection training to ensure the proper use of respirators and to inform employees on the respiratory hazards to which they are exposed.
