29 CFR  1926.651(g)(1)(i): Where oxygen deficiency (atmosphere containing less than 19.5 percent oxygen) or a hazardous atmosphere existed or could reasonably be expected to exist, such as in excavations in landfill areas or excavations in areas where hazardous substances are stored nearby, the atmospheres in the excavation shall be tested before employees enter excavations greater than 4 feet in depth:  On or about March 1, 2024, employees worked in an excavation connecting a new sewer line to an existing sewer line where a hazardous atmosphere could reasonably be expected to exist.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  On or about March 1, 2024, and at times prior thereto, the employer did not keep the excavation clear of equipment (excavator) and other materials 2 feet or more from the edge of the trench to prevent materials from falling into the excavation and added pressure to the trench wall.   Employees were exposed to cave-in and engulfment hazards.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface side rails did not extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.  On or about March 1, 2024, employees used a portable ladder to access and egress an excavation that did not have the side rails extended 3-feet above the upper landing surface.
