29 CFR  1910.120(q)(1):  The employer did not develop and implement an emergency response plan to handle anticipated emergencies prior to commencement of emergency response operations:  a) On or about March 4, 2024, at the furnace slag pit, the emergency response plan procedures were not implemented with respect to a fire emergency.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire hazards when operating wheel loaders inside slag pits:    a) On or about March 4, 2024, at the furnace slag pit, an employee was exposed to fire hazards when operating a CAT 988H Hot Pit Loader, Unit #15334, over molten slag.  The TMS International was previously cited for a violation of the Occupational Safety and Health Act of 1970, Section (5)(a)(1), which was contained in OSHA inspection number 1491143, citation number 1, item number 1 and was affirmed as a final order on April 8, 2021, with respect to a workplace located at 1 Steel Mill Rd, Seguin, TX 78155.
