OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.    a) At 200 E. Koeln Avenue, St Louis, MO, 63111, in the production plant and around the shipping docks.      On or about March 11, 2024, employees engaged in material handling activities and were exposed to crush-by hazards while operating powered industrial trucks.   An employee suffered a fatal injuries when he was ejected from a Nissan Model MCPL02A225LV s/n CPLo2-9P6675, when the forklift fell approximately 4 feet from the loading dock.  Among other methods, feasible and acceptable methods to correct this hazardous condition would be:    1. Adhere to and require the use of the seat belt in accordance with the Consensus Standard ANSI B56.1-2012, Safety Standard for Powered Industrial Equipment, Section 5.3.19 which states: "An active operator protection device or system, when provided, shall be used."    2. Adhere to the manufacturer's warnings to wear seat belts when operating the equipment.   3. Employer had rules concerning the use of seat belts on powered industrial trucks, however, did not enforce seat belt use during operation of powered industrial equipment.

29 CFR  1910.178(m)(7): Brakes were not set and/or wheel blocks were not in place to prevent movement of trucks, trailers, or railroad cars while loading and unloading:  At 200 E. Koeln Avenue, St Louis, MO, 63111, On or about March 11, 2024, the employer failed to ensure over the road trucks were secured against movement when arriving at the loading dock.  This condition resulted in truck movement away from the loading dock when a forklift entered the trailer to unload a pallet of materials.

29 CFR  1910.147(c)(6)(i):The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed.  At 200 E. Koeln Avenue, St Louis, MO, 63111, On or about March 11, 2024, Employees were exposed to the hazards associated with the unexpected energization of equipment due to the periodic energy control procedures not being inspected at least annually to ensure that the procedure and the requirements of the standard are being followed.  Among these requiring maintenance and lockout are: Load Hoist R M6 dated 12/13/2022, Mech 6 Parts Loader dated 9/15/22, Ultrasonic #1 dated 6/20/22, Vibrating 14-1 3/23/2022 and another for 12/13/2022, Advance Parts Dumper dated 12/15/2021, Part washer dated 9/9/2021, Tumble blaster #1 dated 6/20/2021, Goff Torit D/C dated 3/23/21, Pangborn Hand Blaster dated 9/15/22, Clemcol Zero Double blast cabinet dated 6/20/22, Barrel Tumbler 5 dated 4/21/21, Barrel Tumbler 10 dated 12/15/2021 and 12/13/2022, Spin Dryer #2 dated 9/9/2021, Tumble Blaster #2 dated 6/20/2021, Shaker Conveyor dated 9/15/22, and Dust Collector #2 dated 6/20/22.   Additionally the BT-10 was dated for 12/23/24, and BE Parts washer dated 12/23/24 and 3/23/2021.   The Apex Metal Finishing Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.147(c)(6)(i), which was contained in OSHA inspection number 1518960, citation number 1, item number 2 and was affirmed as a final order on May 25, 2021, with respect to a workplace located at 200 E. Koeln Avenue, St Louis, MO, 63111.
