OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.    a) At 200 E. Koeln Avenue, St Louis, MO, 63111, in the production plant and around the shipping docks.      On or about March 11, 2024, employees engaged in material handling activities and were exposed to crush-by hazards while operating powered industrial trucks.   An employee suffered a fatal injuries when he was ejected from a Nissan Model MCPL02A225LV s/n CPLo2-9P6675, when the forklift fell approximately 4 feet from the loading dock.  Among other methods, feasible and acceptable methods to correct this hazardous condition would be:    1. Adhere to and require the use of the seat belt in accordance with the Consensus Standard ANSI B56.1-2012, Safety Standard for Powered Industrial Equipment, Section 5.3.19 which states: "An active operator protection device or system, when provided, shall be used."    2. Adhere to the manufacturer's warnings to wear seat belts when operating the equipment.   3. Employer had rules concerning the use of seat belts on powered industrial trucks, however, did not enforce seat belt use during operation of powered industrial equipment.
