29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) and as referenced by the note contained in 1926.602(d) :  a)  At 5251 W Nine Mile Road, Building 5 The Quinn, Pensacola, Florida:  On March 27, 2024; the employer allowed an employee to operate a Tele-Handler on site that was not trained and certified on its operations exposing employees to struck-by hazards.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a)  At 5251 W Nine Mile Road, Building 5 The Quinn, Pensacola, Florida:  On March 27, 2024; the employer allowed his employee to perform framing activities without first ensuring his employee was trained on the hazards associated with falls to include but not limited to setting up and inspecting fall protection exposing his employee to a fall hazard of  31 feet  to the ground below.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At 5251 W Nine Mile Road, Building 5 The Quinn, Pensacola, Florida:  On March 25, 2024; the employer failed to ensure employees involved in framing activities were using fall protection exposing his employees to a fall hazard of  31 feet to the ground below.  The EVAL Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1460271, citation number 1, item number 1and was affirmed as a final order on June 18, 2020, with respect to a workplace located at 2004 98 Palm Boulevard, Village Destin Apartment, Destin, Florida.
