29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: On or about April 18, 2024, and at times prior thereto, employees were exposed to hazardous noise levels without an available audiometric testing program while performing production of a concrete ready-mix products: a. The Labor was exposed to a noise level of 88.29 dBA during a 462 minutes sampling period; b. The Labor was exposed to a noise level of 88.55 dBA during a 472 minutes sampling period; and, c. The Labor was exposed to a noise level of 89.66 dBA during a 465 minutes sampling period.

29 CFR 1910.253(b)(2)(ii): Assigned storage spaces for cylinders was not located away from elevators, stairs, or gangways where cylinders could not be knocked over or damaged by passing or falling objects, or subject to tampering by unauthorized persons:(a)(LOCATION)(IDENTIFY SPECIFIC OPERATIONS AND/OR CONDITIONS)(IDENTIFY SOURCE OF HEAT) On or about March 28, 2024, and at time prior thereto, in the mechanic shop, employees utilized compressed acetylene cylinder that was not stored and properly secured. This conditions exposed employees to fire and damage to the cylinder in the event of an accident.
