29 CFR  1926.451(f)(1): Scaffold and/or scaffold components were loaded in excess of their maximum intended loads or rated capacities, whichever was less:  a) On March 29, 2024, a Caterpillar TL1055D telehandler with a work basket attached was used to elevate employees performing framing activities. The total weight of the work basket, the boom angle, boom length and position of the outriggers combined, exceeded the rated lift capacity load as specified for this machine.

29 CFR  1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:  a) On March 29, 2024, and at times prior the employer used a Caterpillar TL1150D telehandler with a 14' x 4' work basket attached for framing activities at elevation.  The platform was not approved by the manufacturer and the employer did not evaluate what effect the additional weight and overall length of the work basket would have on the rated lift capacity, the stability and safe operation of the machine.

29 CFR  1926.454(a): The employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  a) On March 29, 2024, and times prior a Caterpillar TL1150D telehandler with an attached work basket was used as a temporary work surface to perform framing activities.  The telehandler operator and the worker in the basket had not received scaffold related training and did not recognize the stability hazards when using this machine with this basket attached and take the precautions needed to minimize these hazards.

29 CFR  1926.602(d): The employer did not ensure that each employee operating a powered industrial vehicle had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178, and as referenced by the note contained in 1926.602(d).   a) On March 29, 2024, and at times prior employees performed framing activities using a Caterpillar TL1150D telehandler with an attached work basket.  The employer did certify and provide training and evaluation of safe handling and operating procedures.
