29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): On or about April 24, 2024, workers were exposed to struck-by hazards while attempting to jumpstart a stalled JLG Skytrak Telehandler Forklift that was positioned on a sloped driveway without controlling the unexpected movement of the equipment.

29 CFR 1926.602(d): The employer did not ensure that each employee operating a powered industrial vehicle had been trained and evaluated as required by paragraph 29 CFR 1910.178(l). In the alternative - 29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). On or about April 24, 2024, on the inclined driveway, an employee operated a JLG Skytrak Telehandler Forklift without receiving training and evaluation from the employer.
