29 CFR 1910.266(h)(1)(iv): Employee(s) approached a feller closer than two tree lengths of trees being felled without the feller acknowledging that it was safe to do so:  a)Eldora Enterprises, LLC DBA Eldora Mountain Resort: On or about, May 16, 2024, and at times prior, the employer did not ensure employees were not exposed to crushing hazards while felling trees. An employee entered the fall radius of a tree being felled and the feller did not effectively acknowledge and communicate it was not safe to approach. This condition exposed an employee to crushing hazards as a result of being in the danger zone or felling radius of the tree.

29 CFR  1910.266(i)(3)(iii): Recognition of safety and health hazards associated with the employee's specific work tasks, including the use of measures and work practices to prevent or control those hazards:   a)Eldora Enterprises, LLC DBA Eldora Mountain Resort: On May 16, 2024, and at times prior, the employer did not ensure employees were provided with the necessary training on the recognition of safety and health hazards, specific work tasks, and the measures and work practices to prevent or control these hazards during tree felling and logging operations. This condition exposed employees to struck-by hazards.
