On or about June 5, 2024, and at times prior, the employer exposed employees to struck-by and crushing hazards, in that, the JCB Loadall (model 535V140, serial number JCB5APXGK02337616) was equipped with a bucket shovel attachment that was not approved by the manufacturer. b.) On or about July 11, 2024, and at times prior, the employer exposed employees to struck-by and crushing hazards, in that, the JLG telehandler (model G9-43A, serial number 0160010119) was equipped with a bucket shovel attachment that was not approved by the manufacturer.

29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered. a.) On or about June 5, 2024, and at times prior, the employer exposed employees to struck-by and crushing hazards, in that, there were no markings to identify the bucket shovel attachment and show the approximate weight of the truck and attachment combination at maximum elevation with the load laterally centered, nor were the load charts updated on the JCB Loadall (model 535V140, serial number JCB5APXGK02337616) to reflect the bucket attachment. b.) On or about July 11, 2024, and at times prior, the employer exposed employees to struck-by and crushing hazards, in that, there were no markings to identify the bucket shovel attachment and show the approximate weight of the truck and attachment combination at maximum elevation with the load laterally centered, nor were the load charts updated on the JLG telehandler (model G9-43A, serial number 0160010119) to reflect the bucket attachment.

On or about June 5, 2024, and at times prior, the employer exposed employees to struck-by hazards, in that, employees operating the JCB Loadall (model 535V140, serial number JCB5APXGK02337616) equipped with a bucket shovel attachment (D & E 2.75-yard bucket, model GP Bucket, serial number 28179GR1) that obstructed the forward view of the path of travel were not required to travel with the load trailing. IN THE ALTERNATIVE: 29 CFR 1910.178(n)(6): Industrial truck drivers were not required to keep a clear view of the path of travel. a.) On or about June 5, 2024, and at times prior, the employer exposed employees to struck-by hazards, in that, employees were permitted to operate the JCB Loadall (model 535V140, serial number JCB5APXGK02337616) equipped with a bucket shovel attachment (D & E 2.75-yard bucket, model GP Bucket, serial number 28179GR1) that obstructed the forward view of the path of travel.
