29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  (a) On or about June 1, 2024 and times prior, at or near 16105 32nd Street NW in East Fairview, North Dakota, employees were exposed to fall hazards of over 4 feet while opening and closing the lids of trailer mounted sand bins where  a platform gate and halo fall protection system were missing.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye:  (a)  On or about June 1, 2024, at or near 16105 32nd Street NW in East Fairview, North Dakota, an employee injury occurred as the result of a fall  that required hospitalization which was not reported to the Occupational Safety and Health Administration within the required 24 hours.
