OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing job duties:  Employees were exposed to the hazard of high heat from working under direct sunlight during the performance of their job duties, including removal, replacement, and cleanup of the roof of a commercial building over a period of 8 hours during the following instances:  a) On or about June 7, 2024, employees performing moderate manual labor were exposed to temperatures of approximately 93 degrees F with relative humidity levels ranging from 46% to 91%. The calculated Wet Bulb Globe Temperatures (WBGT) between 7:00 AM and 8:00 PM ranged from 72 degrees F to 90 degrees F with a Heat Index up to 99 degrees F.  b) On or about June 8, 2024, employees performing moderate manual labor were exposed to temperatures of approximately 95 degrees F with relative humidity levels ranging from 42% to 77%. The calculated Wet Bulb Globe Temperatures (WBGT) between 7:00 AM and 3:00 PM ranged from 72 degrees F to 90 degrees F with a Heat Index up to 101 degrees F.  Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke. The above conditions resulted in a work-related death of one employee that occurred on June 8, 2024, at approximately 3:00 PM.
