29 CFR 1910.28(c)(3): The employer did not ensure that a barricade was used to keep objects far enough from an edge or opening to prevent them from falling to a lower level.  Location: 198 Pipe Stave Hollow Road, Mount Sinai, NY, 11766  On or before 06-26-2024, Employees who were working in and around a manual tree felling operation were not protected from being struck by felling tree limbs and or tree trunks by a barricade to stop employees from entering  the falling zone.   Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR  1910.135(a)(1):The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects:  Location: 198 Pipe Stave Hollow Road, Mount Sinai, NY, 11766  On or before 06/26/2024,  An employee was not wearing a protective helmet when working directly below overhead tree trimming, exposing the employee to being struck by falling tree limbs.  Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
