OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush by hazards:     (a) On May 30, 2024, and times prior, at or near 324 26th Street East in Williston, North Dakota, employees were exposed to crush by hazards while working in close proximity to industrial storage racks that were not secured against toppling.  Note: Among other methods, feasible and acceptable abatement methods to correct this hazard include but are not limited to:  1. Follow the recommendations of ANSI MH 16.1 - Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks, Sections 1.4 - Integrity of Rack Installations

29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    (a) On May 30, 2024, and times prior, at or near 324 26th Street East in Williston, North Dakota, employees were exposed to struck by hazards while working in the battery shop, where a powered industrial vehicle is operated by personnel who have not been trained and evaluated as required.
