29 CFR  1926.100(a):  Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns.  On or about July 17, 2024, and at times prior to, on the east side of the jobsite, a subcontractor employee did not wear a protective helmet while working in an excavation where an excavator and pipes were adjacent to the edge of the excavation.  Cherokee Pride Construction, Inc. was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.100(a) which was contained in OSHA inspection number 1493069, citation number 03, item number 01 and was affirmed as a final order on August 2, 2021, with respect to a workplace located at the corner of 91st and Aspen in Broken Arrow, OK 74012.

29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees.  On or about July 17, 2024, and at times prior to, at the east side of the jobsite, a subcontractor employee worked in an excavation where no ladder, ramp, or stairs provided a safe means of egress from the excavation which was more than 4 feet in depth.  Cherokee Pride Construction, Inc. was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.651(c)(2) which was contained in OSHA inspection number 1493069, citation number 04, item number 01 and was affirmed as a final order on August 2, 2021, with respect to a workplace located at the corner of 91st and Aspen in Broken Arrow, OK 74012.

29 CFR  1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.     On or about July 17, 2024, and at times prior to, at the east side of the jobsite, a subcontractor employee worked in an excavation and the ladder for excavation entry and egress did not have ladder rails that extended at least 3 feet above the top of the excavation.  Cherokee Pride Construction, Inc. was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.1053(b)(1) which was contained in OSHA inspection number 1493069, citation number 04, item number 04, and was affirmed as a final order on August 2, 2021, with respect to a workplace located at the corner of 91st and Aspen in Broken Arrow, OK 74012.
