29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. a) On or about July 30, 2024, the Doscher's Candies LLC did not establish an energy control program that consisted of energy control procedures, employee training and periodic inspections to utilize for operators of the Latini cane machine that were exposed to rotating parts and pinch points hazards while cleaning and clearing jams.

29 CFR 1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence: (d)(1) Preparation for shutdown. Before an authorized or affected employee turns off a machine or equipment, the authorized employee shall have knowledge of the type and magnitude of the energy, the hazards of the energy to be controlled, and the method or means to control the energy. (d)(2) Machine or equipment shutdown. The machine or equipment shall be turned off or shut down using the procedures established for the machine or equipment. An orderly shutdown must be utilized to avoid any additional or increased hazard(s) to employees as a result of the equipment stoppage. (d)(3) Machine or equipment isolation. All energy isolating devices that are needed to control the energy to the machine or equipment shall be physically located and operated in such a manner as to isolate the machine or equipment from the energy source(s). (d)(4) Lockout or tagout device application. Lockout or tagout devices shall be affixed to each energy isolating device by authorized employees. (d)(5) Stored energy. Following the application of lockout or tagout devices to energy isolating devices, all potentially hazardous stored or residual energy shall be relieved, disconnected, restrained, and otherwise rendered safe. (d)(6) Verification of isolation. Prior to starting work on machines or equipment that have been locked out or tagged out, the authorized employee shall verify that isolation and deenergization of the machine or equipment have been accomplished. a) On or about July 30, 2024 the employer did not ensure authorized employees controlled the hazardous energy of the Latini candy cane machine utilizing sequence (d)(1) through (d)(6) while cleaning and clearing jams, exposing employees to rotating parts and pinch points.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc. a) On or about July 30, 2024, the employer did not guard pinch points of the cutter and ingoing nip points of the hotdog roller and chain and sprocket on the shaping area of the Latini Candy Cane machine during production to prevent operators from reaching into rotating and moving parts.
