29 CFR 1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition: (a) Pellet Mills; On or about August 27, 2024, employees were exposed to potential fire and explosion hazards due to insufficient housekeeping practices. The frequency of cleaning did not reduce accumulations of combustible wood dust on ledges, floors, and equipment. The pellet mills had poor process containment and did not have sufficient dust collection to capture the large amounts of dust produced during the manufacturing, cooling, and transporting of wood pellets. (b) Cooling Room; On or about August 27, 2024, employees were exposed to potential fire and explosion hazards due to insufficient housekeeping practices. The frequency of cleaning did not reduce accumulations of combustible wood dust on ledges, floors, and equipment.

The ladder was not tagged with language indicating the danger nor was it taken out of service.

29 CFR 1910.29(g)(3): The employer did not ensure that cages and wells are designed, constructed, and maintained to contain employees in the event of a fall, and to direct them to a lower landing: (a) Clean air exhaust stacks near dust baghouse; On or about August 27, 2024, the employer did not ensure the cage for a 31-foot fixed ladder attached to a maintenance deck was maintained in a condition that would contain employees in the event of a fall. The cage had two broken mounting welds on the left side and one on the lower right, leaving the cage hanging lose on approximately 12 feet of the left side.
