29 CFR 1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  a) On or about 09/01/2023 at residential apartment complex, located at 6386 Transit Rd in Depew NY; employees were using a boom lift to access work areas while installing roofing material.  The employees in the lift did not have a harness with lanyards attached to the boom or basket.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  a) On or about 09/01/2024 at a roof project located at 6386 Transit in Depew NY; employees were installing shingles on the roof of a four-story residential apartment complex. The roof had a 4 in 12 pitch and an eave height of approximately 40 feet. There was no fall protection in use.   NO ABATEMENT CERTIFICATION REQUIRED
