29 CFR  1910.28(b)(1)(i):  The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  a) At CEMCO Model 275 Portable Batch Plant at Southern Allied Ready Mix facility: On or about October 14, 2024, and at times prior, the employer exposed employees to falls hazards of approximately five feet, in that abatement (i.e. personal fall restraint, or elevated platform) were not provided to employees while attempting to toss rope to co-worker at the top of the hopper.  b) At CEMCO Model 275 Portable Batch Plant at Southern Allied Ready Mix facility: On or about October 14, 2024, and at times prior, the employer exposed employees to falls hazards of approximately eighteen (18) feet, in that abatement (i.e. personal fall restraint, or fall arrest) were not provided to employees while attempting to work at the top of the hopper.
