OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: At the facility located at 210 Kelly Road in Buffalo, Missouri: On or about October 7, 2024, employees in the shipping and painting area were exposed to a struck-by and caught-in-between hazard while working with, and near, vertically staged steel roof trusses posing the risk of toppling over when displaced. AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THIS HAZARD ARE: i. Evaluate and implement methods to ensure that vertically stored trusses are protected against accidental displacement. ii. Formalize and train employees on truss handling procedures that remove employees from the danger zone during truss handling operations. iii. Evaluate and implement suitable tools and materials that allow employees handle trusses from a distance outside of the struck-by danger zone. The tools and materials may include, but are not limited to, wireless crane controls and tag lines.

The employer has failed to perform a recent periodic inspection to look for cracks or breaks of critical components of all the overhead gantry cranes ( Macko C9511-1188, Macko C9510-1180-2, Macko C9809-1583, Macko C9510-1180-1) and the degree of their exposure to wear, deterioration, or malfunction.

29 CFR 1910.179(l)(3)(iii)(d): Pendant control stations were not kept clean and function labels were not kept legible: At the facility located at 210 Kelly Road, Buffalo, Missouri- On or about October 7, 2024, employees were exposed to overhead hazards as well as struck-by hazards while operating Macko Material Handing C9511-1188 gantry crane. The pendant controls and the remote pedant controls were covered in paint and were illegible for employees to know what buttons control what actions.
