29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed: On or about October 22, 2024, the employer did not ensure periodic inspections of energy control procedures were conducted annually, including a review of each authorized employee's responsibilities under the energy control procedures. Authorized employees are required to conduct and direct service and maintenance activities on machinery including the Powermatic CS-18 Upcut/Chop Saw & Smetco Pallet Disassembler, with energy sources including, but not limited to, Electrical, Pneumatic, and Hydraulic.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about October 14, 2024, the employer did not ensure one or more methods of machine guarding were provided to protect the operator and other employees working at the Powermatic CS-18 Upcut/Chop Saw, when employees utilize a foot pedal to power the upcut saw blade with the ability to have their hands underneath of the guard and within the point of operation. The existing guard was ineffective and resulted in an amputation injury.
