29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met, and had not developed or implemented a written hazard communication program which included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): a) 5043 Webber Road, Mohnton, PA 19540: On or about October 29, 2024, employees were utilizing hazardous cleaning chemicals and the employer's written hazard communication program was inadequate in that it did not outline container labeling requirements for mixed chemicals in IBC totes, safety data sheet (SDS) access for employees working in the field, and employee training requirements outlining how to prevent chemical exposures and the personal protective equipment (PPE) required. b) 5043 Webber Road, Mohnton, PA 19540: On or about October 29, 2024, employees were utilizing hazardous cleaning chemicals and the employer's written hazard communication program was inadequate in that it did not contain all hazardous substances in the workplace, such as the Truck Wash Cleaning Kit Powder Pail (labeled as "Non-Toxic Truck Soap"). c) 5043 Webber Road, Mohnton, PA 19540: On or about October 29, 2024, employees were utilizing hazardous cleaning chemicals and the employer's written hazard communication program did not describe the methods the employer will use to inform employees of the hazards of non-routine tasks. The IBC tote contained the chemical name and corrosion pictogram, but did not include the skull and crossbones pictogram. b) 5043 Webber Road, Mohnton, PA 19540: On or about October 29, 2024, employees were exposed to chemical hazards due to an inadequately labeled IBC tote containing the hazardous cleaning chemical, Big Rig Cleaner. The IBC tote contained the chemical name and corrosion pictogram, but did not include additional hazard information including, but not limited to the signal word and hazard statement. c) 5043 Webber Road, Mohnton, PA 19540: On or about October 29, 2024, employees were exposed to chemical hazards due to an inadequately labeled IBC tote containing the hazardous cleaning chemical, Truck Wash Cleaning Kit Powder Pail, labeled as "Non-Toxic Truck Soap." Pictograms and hazard information was not present on the container. Abatement certification required within 10 days after abatement date.
