29 CFR  1910.22(d)(1):(1) Walking-working surfaces are inspected, regularly and as necessary, and maintained in a safe condition;  On or about October 31, 2024, employees were exposed to struck-by hazards from unsafe walking-working surfaces due to potholes located in the forklift traffic areas. On September 9, 2024, an employee was injured while walking next to a forklift serving as a spotter, the forklift drove over a pothole, lost it's load, and landed on the employee's foot causing fractures to two toes.  Abatement certification is required for this item in accordance with 29 CFR 1903.19(c).

29 CFR  1910.178(q)(1): The employer failed to ensure any power-operated industrial truck not in safe operating condition was removed from service. All repairs shall be made by authorized personnel.  On or about October 31, 2024, forklift operators were exposed to unsafe operating conditions due to damaged tires on the forklifts. Both of the Hyster 280 forklifts and the Toyota F-192 forklift had chunks missing from the tires.   Abatement certification is required for this item in accordance with 29 CFR 1903.19(c).

(i) The employer did not establish and implement a written exposure control plan that contains at least the following elements:  On or about October 31, 2024, employees who were exposed to respirable crystalline silica were not provided with a written silica exposure plan. Employees must clean equipment returned from construction use that may contain silica from concrete.   Abatement certification is required for this item in accordance with 29 CFR 1903.19(c).
