29 CFR  1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.  On or about November 1, 2024, at an establishment located at 3895 Crop Care Ct., Amherst Junction, WI 54407, the employer did not ensure that the Toyota Model 8FGU25. Serial No. 50894 was equipped with a tag or decal for employees using a Ballymore man basket.

29 CFR  1910.178(o)(1): Only stable or safely arranged loads shall be handled. Caution shall be exercised when handling off-center loads which cannot be centered.  On or about November 1, 2024, at an establishment located at 3895 Crop Care Ct., Amherst Junction, WI 54407, the employer did not ensure that employees had maintained a stable load center when attempting to lower a large conveyor system with several LP Powered Forklifts.

29 CFR  1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  On or about November 1, 2024, at an establishment located at 3895 Crop Care Ct., Amherst Junction, WI 54407, the employer did not ensure that employees operating LP sit down forklifts had been trained to the requirements of section (l) of this standard prior to operating the powered industrial vehicles, exposing employees to potential struck-by and crushing hazards.
