29 CFR  1926.62(d)(2)(v): Prior to the performance of an employee exposure assessment as required under paragraph (d) of this section, the employer did not provide to employees performing the tasks described in paragraphs (d)(2)(i) through (d)(2)(iv) of this section with interim protection, as indicated in paragraphs (d)(2)(v)(A) through (d)(2)(v)(F):   a. 37 West 2nd Street - On or about November 6, 2024, the employees were performing gut rehab/demolition work on a residential building to prepare it for multiple tenants, prior to the start of the demolition, the employer had not conducted an employee assessment of potential lead exposure and did not provide the employees with respiratory protection in accordance with (d)(2v)(A), the employees were using surgical masks in lieu of a respirator.  b. 37 West 2nd Street - On or about November 6, 2024, the employees were performing gut rehab/demolition work on a residential building to prepare it for multiple tenants, prior to the start of the demolition, the employer had not conducted an employee assessment of potential lead exposure and did not provide the employees with protective clothing in accordance with (d)(2v)(B), the employees were not using coveralls or other disposable type garments or laundering facilities and gloves that would be disposable or left at the work site.  c. 37 West 2nd Street - On or about November 6, 2024, the employees were performing gut rehab/demolition work on a residential building to prepare it for multiple tenants, prior to the start of the demolition, the employer had not conducted an employee assessment of potential lead exposure and did not provide the employees with changing areas in accordance with (d)(2v)(C). The employees went directly from doing the work to getting into a van and departing the work site.  d. 37 West 2nd Street - On or about November 6, 2024, the employees were performing gut rehab/demolition work on a residential building to prepare it for multiple tenants, prior to the start of the demolition, the employer had not conducted an employee assessment of potential lead exposure and did not provide the employees with hand washing facilities in accordance with (d)(2v)(D). The employees went directly from doing the work to getting into a van and departing the work site.  e. 37 West 2nd Street - On or about November 6, 2024, the employees were performing gut rehab/demolition work on a residential building to prepare it for multiple tenants, prior to the start of the demolition, the employer had not conducted an employee assessment of potential lead exposure and did not provide the employees with biological monitoring (d)(2v)(E).
