29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall: (a) On or about November 8, 2024, in the tank mixing room, the employer had not adequately conducted a hazard assessment for refilling operations of MPA No. 168 (Nitric acid and Phosphoric acid compound) while transferring pipe fed MPA No. 168 into 55-gallon drums. The employees stand near the 55 gallon drum while using a wand and hose to refill the 55-gallon drum, exposing employees to potential toxic inhalation hazard.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form. (a) On or about November 8, 2024, in the tank mixing room, employees perform refilling operations of MPA No. 168 (Nitric acid and Phosphoric acid compound) while transferring pipe fed MPA No. 168 into 55-gallon drums. A respiratory hazard exposure assessment to MPA No. 168 (Nitric acid and Phosphoric acid compound) was not completed to determine level of personal protective equipment (PPE) to be utilized.
