29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: On or about November 14, 2024, the employer had not developed a written hazard communication program which included labeling requirements, safety data sheet maintenance and storage, and information and training criteria for employees exposed to hazardous chemicals such as, but not limited to aluminum oxide, garnet, and black monument lettering paint which are used by employees for abrasive blasting and to paint etchings on monuments. Employees were exposed to contact and inhalation hazards which could result in health effects such as irritation to the lungs, skin and eyes.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: On or about November 14, 2024, the employer had not provided information and training on hazardous chemicals such as but not limited to aluminum oxide, garnet, and black monument lettering paint which are used by employees for abrasive blasting and to paint etchings on monuments. Training should cover the written hazard communication program, health hazards associated with the chemicals, methods to detect the release of hazardous chemicals, measures employees can take to protect themselves from exposure to the chemicals, and safety data sheets.

29 CFR 1910.1053(d)(1): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section: On or about November 14, 2024, the employer did not assess employee exposure to respirable crystalline silica during processes such as but not limited to operating the abrasive blasting booth to engrave stone monuments. Employees are potentially exposed to respiratory hazards related to silica when engraving on natural stone products in the workplace.
