29 CFR 1926.300(b)(1): When power operated tools are designed to accommodate guards, they were not equipped with such guards when in use.  On or about November 15, 2024, the employer failed to implement guards or proper control methods for the handheld saw and angle grinders such as the Makita Angle Grinder, when employee's cut or grind down quartz countertop backsplashes to install in homes. The lack of guards on each handheld tool exposes each employee to potential laceration injuries when cutting or grinding down quartz countertops.

29 CFR 1926.1153(d)(2)(i): General. The employer did not assess the exposure of each employee who is or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section.  On or about November 15, 2024, the employer failed to conduct an exposure assessment for respirable crystalline silica for employees who worked at the temporary site at 5343 Walnut Ridge Lane in Sheffield Lake Ohio, 44054 for tasks that contained silica dust including but not limited to cutting and grinding down countertops and backsplashes made of quartz. This kind of product contains hazardous respirable products including but not limited to respirable crystalline silica.
