OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:  a) On or about November 20, 2024, in the rail load-out area, shipping employees walking and standing on the roof of moving railcars were exposed to struck-by hazards during railcar movement.  b) On or about November 20, 2024, in the rail load-out area, Quality Control employees walking and standing on the roof of moving railcars were exposed to struck-by hazards during railcar movement.

29 CFR 1910.140(c)(18): The employer did not ensure that personal fall protection systems are inspected before initial use during each work shift for mildew, wear, damage, and other deterioration, and defective components are removed from service:  On or about November 20, 2024, on the top-level of railcars, employees utilized personal fall protection systems that were not inspected prior to employees starting their work shift.
