29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) On or about December 3, 2024, and at times prior, at 925 19th AVE NW, Birmingham, AL 35215, Gulf Coast Underground, LLC, employees were in the process of installing a liner in an active sanitary sewer system had not been trained by the employer to recognize and avoid hazards associated with process/operation such as but not limited to struck-by hazards, crush hazards, In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.600(a)(3)(ii): Equipment parked on an incline did not have the wheels chocked and the parking brake set: (a) On or about December 3, 2024, and at times prior, at 925 19th AVE NW, Birmingham, AL 35215, Gulf Coast Underground, LLC, employees worked between a refrigeration truck (Equipment 1710) and a steam boiler/air truck parked on an incline/slope without the use of chock blocks exposing employees to struck-by and crush-by hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1926.601(b)(4): The employer had in use motor vehicle equipment having an obstructed view to the rear which did not have a reverse signal alarm audible above the surrounding noise level or an observer signaling it was safe to back up the vehicle. (a) On or about December 3, 2024, and at times prior, at 925 19th AVE NW, Birmingham, AL 35215, Gulf Coast Underground, LLC, employees working between a refrigeration truck (Equipment 1710) and a steam boiler/air truck (Equipment SBR3 ) parked on an incline/slope were exposed to struck-by and crush-by hazards when equipment 1710 backed up having an obstructed view to the rear without a flagger and without the reverse signal alarm audible above the surrounding noise level. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. (a) On or about December 3, 2024, and at times prior, at 925 19th AVE NW, Birmingham, AL 35215, Gulf Coast Underground, LLC, failed to ensure confined spaces were evaluated by a competent person for characteristics of a permit space when employees entering an active sewer system in preparation for inversion installation. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
