29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  (a) On or about December 3, 2024, and at times prior, at 925 19th AVE NW, Birmingham, AL 35215, Gulf Coast Underground, LLC, employees were in the process of installing a liner in an active sanitary sewer system had not been trained by the employer to recognize and avoid hazards associated with process/operation such as but not limited to struck-by hazards, crush hazards,   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.601(b)(4): The employer had in use motor vehicle equipment having an obstructed view to the rear which did not have a reverse signal alarm audible above the surrounding noise level or an observer signaling it was safe to back up the vehicle.   (a) On or about December 3, 2024, and at times prior, at 925 19th AVE NW, Birmingham, AL 35215, Gulf Coast Underground, LLC, employees  working between a refrigeration truck (Equipment 1710) and a steam boiler/air truck (Equipment SBR3 ) parked on an incline/slope were exposed to struck-by and crush-by hazards when equipment 1710 backed up  having an obstructed view to the rear without a flagger and  without the  reverse signal alarm audible above the surrounding noise level.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.1203(a):Before it begins work at a worksite, each employer must ensure that a competent person identifies all confined spaces in which one or more of the employees it directs may work, and identifies each space that is a permit space, through consideration and evaluation of the elements of that space, including testing as necessary.  (a) On or about December 3, 2024, and at times prior, at 925 19th AVE NW, Birmingham, AL 35215, Gulf Coast Underground, LLC, failed to ensure confined spaces were evaluated by a competent person for characteristics of a permit space when employees entering an active sewer system in preparation for inversion installation.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.1204(h):(h) Designate each person who is to have an active role (as, for example, authorized entrants, attendants, entry supervisors, or persons who test or monitor the atmosphere in a permit space) in entry operations, identify the duties of each such employee, and provide each such employee with the training required by �1926.1207;  (a) On or about December 3, 2024, and at times prior, at 925 19th Ave NW, Birmingham, AL 35215, Gulf Coast Underground, LLC failed to designate roles per person who assisted in or entered the permit space while employees were working in an active sewer system.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
