29 CFR  1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as identified in standards 1926.502(d)(15)(i)-1926.502(d)(15)(ii).  a) On or about December 18, 2024, at the worksite located at 3091 North Casaloma Drive, Appleton, Wisconsin; the employer did not ensure that an employee was attached to an anchor that was part of fall protection system that would support at least 5,000 pounds, exposing an employee to fall hazards.  The employee had their lanyard tied around the framing of a window.

29 CFR  1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a) On or about December 18, 2024, at the worksite located at 3091 North Casaloma Drive, Appleton, Wisconsin; the employer did not ensure that each employee working near unprotected sides or edges while performing framing work was protected from falls, exposing employees to fall hazards. There were two employees engaged in the nailing of floor sheathing on the second story of the building, while exposed to an unprotected fall of approximately 13 feet above a lower level. There were two employees engaged in the clean-up work on the second story of the building, while exposed to an unprotected fall of approximately 14 feet without fall protection. Two of these employees were wearing no fall protection, while two of these employees were wearing a fall protection system that was rigged in a manner that would have allowed them to fall to the lower level.  TMC Built, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1538842, citation number 1, item number 1, and was affirmed as a final order on September 15, 2021, with respect to the worksite located at the Corner of Innovation Ct and Tri-Park Way, Appleton, WI 54914.  TMC Built, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1486945, citation number 1, item number 1, and was affirmed as a final order on September 22, 2020, with respect to the worksite located at Howard Commons and Riverwood Lane, Howard, WI 54313.  TMC Built, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1455064, citation number 1, item number 2, and was affirmed as a final order on April 17, 2020, with respect to a workplace located at Howard Commons and Riverwood Lane, Howard, WI 54313.
