29 CFR 1926.602(c) Lifting and hauling equipment (other than equipment covered under subpart N of this part) (1) Industrial trucks shall meet the requirements of § 1926.600 and the following: (vi): All industrial trucks in use shall meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.  a) On or about January 8, 2025, the employer failed to ensure that the industrial truck (telehandler) used to lift a steel beam was operated in accordance with the applicable requirements for operation as defined in the American National Standards Institute (ANSI) B56.1?1969, Safety Standard for Powered Industrial Trucks, as incorporated by 29 CFR 1926.602(c)(1)(vi). Specifically, the lift was performed under unusual operating conditions involving a blind lift, the employer failed to implement additional safety precautions or special operating instructions, as required under Section 4.1.2 of the standard.  The operator was not guided in developing safe working habits or made aware of hazardous conditions, as required by Section 5.1.2. Furthermore, the truck was not operated in a manner that safeguarded personnel in violation of Section 5.2.7, and the operator had not been familiarized with the hazards associated with blind lifting prior to the operation, contrary to Section 5.1.5. As a result of these failures to follow the operational requirements of ANSI B56.1, an employee who was guiding the beam suffered a crushing injury and the subsequent amputation of two fingers on their right hand.

29 CFR 1926.21(b) Employer Responsibility. (2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.   a) On or about January 8, 2025, the employer failed to instruct employees involved in beam installation activities on the recognition and avoidance of unsafe conditions associated with performing blind lifts using a telehandler. Specifically, employees were not made aware of the hazards posed by guiding unsecured loads during blind lifts conducted without specialized procedures, safety precautions.  As a result, an employee suffered a crushing injury and subsequent amputation of two fingers on the right hand while guiding a horizontal steel beam into place for welding to a vertical column.

Note: The requirements applicable to construction work under this paragraph are identical to those set forth at §1910.178(l) of this chapter. [44 FR 8577, Feb. 9, 1979; 44 FR 20940, Apr. 6, 1979, as amended at 58 FR 35183, June 30, 1993; 63 FR 66274, Dec. 1, 1998]  29 CFR 1910.178 (l)(4) Refresher training and evaluation. (ii) Refresher training in relevant topics shall be provided to the operator when: B: The operator has been involved in an accident or near-miss incident.    a) On or about January 8, 2025, the employer failed to ensure that refresher training in relevant topics was provided to the powered industrial truck (telehandler) operator when the operator was involved in a workplace accident, as required by 29 CFR 1910.178(l)(4)(ii)(B), incorporated by reference into 29 CFR 1926.602(d).  Specifically, the operator was performing a blind lift using a telehandler to position a steel beam, which resulted in another employee sustaining a crushing injury and the subsequent amputation of two fingers.
