29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. a) On or about January 30, 2025, at a worksite located at 3427 Wisconsin Ave NW, Washington, DC, the employer did not have a competent person on site who can recognize hazards associated with trenching/excavations and the means to abate hazards such as methods of protecting employees while working near vertical walls, soil classification, and requirements by soil types. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). a) On or about January 30, 2025, at a worksite located at 3427 Wisconsin Ave NW, DC, employees working in an excavation near estimated 8-foot vertical walls were not protected from cave-ins while pouring concrete into reinforce foundation. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
