29 CFR 1910.28(b)(3)(iv): The employer did not provide that each employee be protected from falling into a ladderway floor hole or ladderway platform hole by a guardrail system and toeboards erected on all exposed sides, except at the entrance to the hole, where a self-closing gate or an offset must be used: a) Line 2 Hopper - On and prior to February 7, 2025, an employee accessed the Line 2 Hopper Platform by utilizing a fixed ladder without a self-closing gate exposing the employee fall hazards of approximately 8 feet in height from the platform to the ground.

29 CFR 1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D): a) Line 1 - On or about February 4, 2025, an employee performing a servicing and/or maintenance task of clearing out a jam of frozen mulch that was stuck in the leveling wheel on Line 1 without performing lockout/tagout. The energy control procedures did not clearly and specifically outline to employees how to lockout/tagout Line 1.
