1910.9(b) Training. Standards in this part requiring training on hazards and related matters, such as standards requiring that employees receive training or that the employer train employees, provide training to employees, or institute or implement a training program, impose a separate compliance duty with respect to each employee covered by the requirement. The employer must train each affected employee in the manner required by the standard, and each failure to train an employee may be considered a separate violation. a) On or about February 14, 2025, the employer failed to ensure that an employee operating a powered industrial truck was sufficiently trained to recognize and avoid a pinch point hazard created when removing a debris hopper from the product dump area. Specifically, the employee was not sufficiently trained to recognize a pinch point and to keep their hands out of that area, which resulted in exposure to crushing and amputation hazards.

29 CFR 1910.178(m)(1): Truck operations. Trucks shall not be driven up to anyone standing in front of a bench or other fixed object. a) On or about February 14, 2025, the employer did not ensure that employees operating powered industrial trucks were not driving up to employees who were standing near a fixed object. While a powered industrial truck operator was removing a hopper from a metal frame box, another employee holding a plastic curtain had their hand caught between the hopper and the metal frame.

29 CFR 1910.178(o)(6): Loading. Extreme care shall be used when tilting the load forward or backward, particularly when high tiering. Tilting forward with load engaging means elevated shall be prohibited except to pick up a load. An elevated load shall not be tilted forward except when the load is in a deposit position over a rack or stack. When stacking or tiering, only enough backward tilt to stabilize the load shall be used. a) On or about February 14, 2025, the employer did not ensure that forklift operators used extreme care when tilting the load forward or backward. Employees were exposed to pinch point and caught in hazards when tilting the raised hoppers while standing to the side when pulling the hopper back into upright position.

29 CFR 1910.178(q)(7): Maintenance of industrial trucks. Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. a) On or about February 14, 2025, the employer did not ensure that the Hyster Fortis Forklift - Model H60 FT (sit-down) with the back lights damaged, in that they were taped to be held in place and which had a damaged seat was removed from service until corrected.
