29 CFR 1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) 1600 Avenue of the States, Lakewood, NJ - Third Floor Facade - The employer did not ensure that an employee installing transoms for a curtain wall glazing system on the third floor of the building was protected from falling to a lower level when accessing the work area exposing the employee to a fall hazard of 30 feet, on or about February 20, 2025. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.502(d)(15)(i): Anchorages used for attachment of personal fall arrest equipment were not used as part of a complete personal fall arrest system: a) 1600 Avenue of the States, Lakewood, NJ - Third Floor Facade - The employer did not ensure that an employee installing transoms for a curtain wall glazing system on the third floor of the building was consistently secured to an anchorage point when accessing the work area exposing the employee to a fall hazard of 30 feet, on or about February 20, 2025. b) 1600 Avenue of the States, Lakewood, NJ - Third Floor Facade The employer did not ensure that an employee installing transoms for a curtain wall glazing system on the third floor of the building was attached to the wire rope sling (choker-style) anchorage point as part of the personal fall arrest system. The employee fell 30 feet to the ground and sustained fatal injuries, on or about February 21, 2025. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION AND DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.502(d)(11): Lifelines were not protected against being cut or abraded: a) 1600 Avenue of the States, Lakewood, NJ - Third Floor Façade - An employee installing a curtain wall glazing system was provided with a wire rope sling (choker hitch) anchorage point as part of a personal fall arrest system. The wire rope anchorage was in direct contact with the edge of the welded steel attachment points for the glazing unit assembly without protection from cuts or abrasions, thus exposing the employee to a fall hazard of 30-feet, on or about February 21, 2025. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION AND DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
