29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  Site: 133-25 37 Avenue, Flushing, NY 11354. a). On or about March 03, 2025, and at times prior thereto, the employer failed to ensure employees engaged in metal panels installation on new building balconies were protected from falls of approximately 100 feet from an unprotected side or edge.

29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment were not independent of any anchorage being used to support or suspend platforms and/or were not capable of supporting at least 5,000 pounds (22.2 KN) per employee attached:  Site: 133-25 37 Avenue, Flushing, NY 11354.  a). On or about March 03, 2025,  and at times prior thereto, two employees engaged in metal panel installation on balcony dividers located approximately 10-100 feet above the ground below were connected to the same anchor point as part of their fall protection systems. The K-Strong UAF30090 and Werner A510000 anchors the employees were using were only rated for 5, 000 pounds per person attached, and exposed the employees to falling hazards.
