29 CFR 1926.651(i)(3): Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures: On or about March 6, 2025, employees of Bommarito Construction were conducting drainage improvements for the City of Wentzville at or near 602 East Pitman Avenue, Wentzville, Missouri. The employer exposed employees to engulfment and struck-by hazards by not providing a support system or other method to an undermined area under the concrete roadway which occurred when a Komatsu PC138USLC excavator operator dug the trench to install the improvements.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): On or about March 6, 2025, Bommarito Construction did not protect employees from cave-in and engulfment hazards when installing storm water pipes inside an unprotected trench measuring 7' in depth by 10' in width by 23' in length at a worksite located at 602 East Pitman Avenue in Wentzville, Missouri.
