Employees performing decking work were walking on steel I-beams without the use of guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.

29 CFR 1926.761(c)(3)(ii): The employer did not provide training in the establishment, access, proper installation techniques and work practices required by §1926.760(c): Location: 65 Dykstra's Way East, Monsey, NY a) On or about May 12, 2025, the employer did not provide training in the establishment, access, proper installation techniques and work practices in a Controlled Decking Zone (CDZ). Employees walked along I-beams to retrieve decking material without any fall protection exposing them to falls of approximately 16' to the basement below. NOTE: In addition to abatement certification, the employer is required to submit abatement documentation for this item, failure to comply will result in an additional penalty of $1,000.00 as per 29 CFR 1903.19.
