29 CFR 1910.134(c)(1):The employer did not establish and implement a written respiratory protection program with worksite-specific procedures in any workplace where respirators were necessary to protect the health of the employee or whenever respirators were required by the employer: a. Production Area: On or about June 5, 2025 and at times prior, the employer exposed employees to respiratory hazards, in that employees were required to wear NIOSH approved, 3M brand, half facepiece and N95 filtering facepiece dust mask respirators while spray painting or using epoxy and the employer did not establish and implement a written respiratory protection program that addressed the worksite-specific procedures such as but not limited to employee medical evaluations, fit testing, and training on the use, maintenance and care of the respirators. b. Installing signs in the field: On or about June 5, 2025 and at times prior, the employer exposed employees to respiratory hazards, in that employees were required to wear NIOSH approved, 3M brand, half facepiece and N95 filtering facepiece dust mask respirators while installing signs by drilling into concrete walls and the employer did not establish and implement a written respiratory protection program that addressed the worksite-specific procedures such as but not limited to employee medical evaluations, fit testing, and training on the use, maintenance and care of the respirators.
