29 CFR  1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  a) On July 25, 2025, at the above addressed jobsite, employees were exposed to struck-by hazards from moving and swinging loads or loose material that were being transported by a crane and received by the exposed employees.  The employees were not wearing hard hats.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.502(b)(2): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structure members were not installed between the top edge of the guardrail system and the walking/working surface when there was no wall or parapet wall at least 21 inches (53 cm) high.  a) On July 25, 2025, at the above addressed jobsite, employees were exposed to falls from the fourth floor of a building due to missing midrails or equivalent intermediate structural members when working at the edge.  Employees were not supplied with a standard railing or required to wear fall protection.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  a) On July 25, 2025, at the above addressed jobsite, the portable Werner Fiberglass A-frame ladder used by an employee to access and egress the top of a cinderblock wall, measuring approximately 40 feet from the ground, did not extend to have the side rails extend at least three (3) feet above the upper landing.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   a) On July 25, 2025, at the above addressed jobsite, employees engaged in framing activities were exposed to falls of greater than approximately 11.5 feet without the use of fall protection.  Employees were exposed to interior falls from the top of trusses to the interior floor.    b) On July 25, 2025, at the above addressed jobsite, employees engaged in framing activities were exposed to falls of greater than approximately 46 feet without the use of fall protection.  Employees were exposed to exterior falls from the top of a cinder block wall to the ground.    Driston Custom Carpentry, LLC was previously cited for a violation of this occupational safety and health standard, or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1816893, citation number 1, item number 1 and was affirmed as a final order on May 20, 2025, with respect to a workplace located at 1932 West Wolfram Street in Chicago, Illinois.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
