29 CFR  1926.602(d):The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  On or about September 12, 2025, untrained employees were authorized to operate a JCB telescopic handlers (Model: 510.56 F) at 515 Flat Tops View Dr, Glenwood Springs, Colorado. The employer failed to ensure training to ensure competency with operating the PIV was provided to employees prior to use potentially exposing the operator and other employees working in the immediate area to hazards associated with struck by/crushing injuries.  Note:  The requirements applicable to construction work under this paragraph are identical to those set forth at 1910.179(l) of this chapter.
