Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of being struck-by vehicular traffic:   The employer operated a truck ingress/egress point that intersected a 25 mph exit ramp and intermittently stopped ramp traffic using a flagger, exposing workers to struck-by hazards created by the active vehicular traffic along the exit ramp, on or about September 19, 2025. The employer failed to implement planning and control practices as identified by ANSI/ASSP A10.47-2021, Work Zone Safety for Roadway Construction before conducting operations along the eastbound Nassau Expressway (NY 878) Exit 1N ramp.
