29 CFR 1926.200(c)(1): Caution signs were not used only to warn against potential hazards or to caution against unsafe practices: On or about September 17, 2025 , at a jobsite located at 100 South Park Place Painesville, OH 44077, the employer did not ensure that signage such as caution signs were posted to warn employees against potential fall hazards created by the removal of a section to the fixed guardrail on the second story of the exterior fire exit staircase. Employees were exposed to fall hazards approx. 14 ft. 11 in. to the concrete ground below.

29 CFR 1926.502(b)(3):Guardrail systems were not capable of withstanding, without failure, a force of at least 200 pounds (890 N) applied within 2 inches (5.1 cm) of the top edge, in any outward or downward direction, at any point along the top edge: On or about September 17, 2025 , at a jobsite located at 100 South Park Place Painesville, OH 44077, the employer did not ensure the temporary guardrail system put in place after the removal to a section of an existing guardrail on the second story of the exterior fire exit staircase, was capable of withstanding at least 200 pounds of force exposing employee to fall hazards of approx. 14 ft. 11 in. The temporary guardrail system in place was constructed of 2x4 lumber and not secured.
