29 CFR  1910.28(c)(3):The employer did not barricade the area into which objects could fall, prohibiting employees from entering the area, and keeping objects far enough away from an edge or opening to prevent them from falling to a lower level:  a) Location: 11 Marion Land East Hampton NY. On or about November 29th, 2025 Employees working in and around a manual tree falling operation were not protected from being struck by falling tree limbs and or tree trunks by a barricade to stop employees from entering the falling zone  Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR  1910.135(a)(1):The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects:  a) Location 11 Marion Lane East Hampton NY 11937.  On or about November 29th, 2025 Employee was not wearing protective helmet when working directly below and around tree trimming and tree removal. Employee was  exposed  to being struck by falling tree limbs.  Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
