29 CFR  1926.1053(b)(4):Ladder(s) were used for purposes other than the purpose for which they were designed:  a)  Jobsite located at 2240 Frankford Ave, Philadelphia PA 19125 - On or about June 13, 2025, the employer did not ensure that the employees utilized the 6-foot Warner a frame ladder per the manufacturer's recommendations. An employee used a Werner ladder by standing on the third and fourth rungs while the ladder was in the closed position, leaning on a wall, and situated on uneven soil thus exposing the employees to fall hazards of approximately 3 feet.

29 CFR 1926.1060(a)(1)(iii): The employer did not ensure that each employee using ladders and/or stairways had been trained by a competent person in the proper construction, use, placement, and care in handling the ladders and/or stairways:  a) Jobsite located at 2240 Frankford Ave, Philadelphia PA 19125 - On or about June 13, 2025, the employer did not ensure that each employee using a 6-foot Werner A-frame ladder was trained by a competent person in the use, placement, and care of ladders, thereby exposing employees to fall hazards.
