OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by/Collapse hazards from an unsupported gin pole during demolition of a communication tower.  (a) 1825 Murray Ave, Atlantic City, NJ 08401: Employees were removing a 50 foot tall antenna structure utilizing a 68 foot tall Tower Equipment Co PT21 gin pole that was erected and secured to a 300 foot tall AM Blu Knox communication tower structure. The gin pole failed as the antenna was attempted to be lowered fatally striking an employee on or about 12/05/2025.   (b) 1825 Murray Ave, Atlantic City, NJ 08401: Employees were removing a 50 foot tall antenna structure utilizing a 68 foot tall Tower Equipment Co PT21 gin pole that was erected and secured to a 300 foot tall AM Blu Knox communication tower structure. The gin pole was secured to the communication tower using nylon slings which were not protected or padded against abrasion. The gin pole failed as the antenna was attempted to be lowered fatally striking an employee on or about 12/05/2025.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  (a) 1825 Murray Ave, Atlantic City, NJ 08401: Employees were removing a 50 foot tall antenna structure utilizing a 68 foot tall Tower Equipment Co PT21 gin pole that was erected and secured to a 300 foot tall AM Blu Knox communication towers structure and were not instructed in the recognition and avoidance of unsafe conditions and regulations to avoid injuries and death on or about 12/05/2025. 29 CFR 1926.251(a)(6): Each day before being used, and during use, where service conditions warrant, the sling and all fastenings and attachments were not inspected for damage or defects by a competent person, and damaged or defective slings were not immediately removed from service:  (a) 1825 Murray Ave, Atlantic City, NJ 08401: Employees were removing a 50 foot tall antenna structure utilizing a 68 foot tall Tower Equipment Co PT21 gin pole that was erected and secured to a 300 foot tall AM Blu Knox communication tower structure did not inspect the Liftall Tuflex Nylon slings for damage before being used. EN60 Tuflex Endless Round Slings and EN150 Tuflex Endless Round Slings and were used to secure the Gin Pole to the Communication Tower and each had visible damage but were still used on or about 12/05/2025.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

(a) 1825 Murray Ave, Atlantic City, NJ 08401: Employees were removing a 50 foot tall antenna structure utilizing a 68 foot tall Tower Equipment Co PT21 gin pole that was erected and secured to a 300 foot tall AM Blu Knox communication tower structure did not remove synthetic web slings with damage, punctures and cuts from being used to hoist and secure the gin pole to the communication tower on or about 12/05/2025.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(17): Fixed ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, or corroded components, were not withdrawn from service until repaired:  (a) 1825 Murray Ave, Atlantic City, NJ 08401: Employees were removing a 50 foot tall antenna structure utilizing a 68 foot tall Tower Equipment Co PT21 gin pole that was erected and secured to a 300 foot tall AM Blu Knox communication tower structure and were climbing the steel ladder mounted to the communication tower that was severely rusted and some areas had sections of missing rungs and side rails on or about 12/05/2025.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
