(a)On or about December 11, 2025, and at times prior thereto, Vigor Marine LLC. employees working on the USS Guadalupe were exposed to occupational injuries and illness when their employer failed to ensure that 4 step(s) were equipped with stair rail systems and handrails.  OSHA Instruction: Shipyard Employment "Tool Bag" Directive - CPL 02-00-162 allows for the applicability of 29 CFR 1910.28(b)(11)(ii) in the ship building and ship repair industry.

29 CFR  1910.215(b)(9):The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch:  (a)On or about December 11, 2025, and at times prior thereto,  Vigor Marine LLC employees working in the Carpenters Shop were exposed to occupational injuries when their employer failed to ensure that the adjustable tongue guard on the the Dayton Bench Grinder (LOT N 11230106) did not exceed one fourth inch from the abrasive wheel.  OSHA Instruction: Shipyard Employment "Tool Bag" Directive - CPL 02-00-162 allows for the applicability of 29 CFR 1910.215(b)(9) in the ship building and ship repair industry.
