(b) On or about January 8, 2026, an employee was working while standing on the 1st tier of the scaffolding under those working above was not protected from receiving a head injury in that he was not wearing a protective helmet.

29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary:  (a) On or about January 8, 2026, an employee working while standing on the first tier of tubular welded end frame scaffolding was not protected from falling in that it was not fully planked.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Cross braces were used as a means of access:  (a) On or about January 8, 2026, at least three employees were not protected from falling up to approximately fifteen (15) feet to the ground below in that they were accessing the scaffolding extensions from the second tier of tubular welded end frame scaffolding by using the end frames and cross braces.  (b) On or about January 8, 2026, at least one employee was not protected from falling up to approximately eight and one-half feet to the ground below in that they were accessing the first tier of tubular welded end frame scaffolding by using the end frames and cross braces.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:  (a) On or about January 8, 2026, employees were working to install masonry from extensions of tubular welded end frame scaffolding installed just below the 2nd level and were not protected from falling in that the scaffolding nor the extensions had a rail system.

29 CFR 1926.451(h)(2)(ii): A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below:  (a) On or about February 3, 2021, employees working below welded tubular end frame scaffolding built two tiers tall with extensions, were exposed to a struck-by hazard in that the scaffolding had no toeboards erected along any of the edges.

29 CFR 1926.702(i)(1): Masonry saws were not guarded with a semicircular enclosure over the blade:  (a) On or about January 8, 2026, an employee using a DeWalt chop saw to cut bricks was not protected from being cut, in that the lower guard was held in the up open position by debris jammed into it.
